Lindsay Lohan Avoids Jail Again, Judge Finds No Probation Violation

Actress Lindsay Lohan not only escaped doing more time in jail this week, but a judge also ruled that the young celebrity is now allowed to drink alcohol once again. This is good news for Lohan, as she may finally be able to soon complete the terms of her probation stemming from a 2007 DUI case.

According to KTLA News, Lohan was in court on Thursday after unconfirmed reports alleged that she failed a June 13 alcohol test while she was under house arrest. The actress also allegedly had parties in her home while she was supposed to be on home confinement.

But is this considered a violation of Lohan's probation? Apparently not. Judge Stephanie Sautner said that Lohan is only guilty of "extremely poor judgment by having roof parties while on home confinement." She added that poor judgment is not a violation of probation. The judge did, however, say that Lohan needs to stop having parties while she is under house arrest and that she can now only have one visitor in her home at a time.

The prior judge in this case, Elden Fox, never issued a court order that required Lohan to go through drug and alcohol testing after the actress' SCRAM bracelet was removed in February. Therefore, Judge Sautner could not find that a probation violation did occur in this case. ABC News reported that prosecutors asked this week to reinstate mandatory drug and alcohol testing for Lohan, but that Sautner denied this request.

After this week's hearing, there's now not even a question that Lohan is allowed to drink alcohol. Now might be the perfect time for the actress to celebrate, but unfortunately her celebratory party can't involve more than one other person.
